General Terms and Conditions of Sale

Article 1 – Definitions

These General Terms and Conditions of Sale (hereinafter the "Terms") are offered by Hyralia.

Hereinafter:
"Website": the website www.hyralia.com and all of its pages, the exclusive property of Hyralia.
"Products" or "Services": all of the physical products and services available for purchase on the Website.
"Seller": Hyralia, the legal or natural person offering its products or services on the Website.
"Customer": the internet user, whether a private individual or a business, who makes a purchase on the Website.
"Consumer": any natural person acting for purposes that cannot be attributed to their professional activity.

The internet user is asked to read the Terms carefully and to print or save them before placing an order.
The Customer declares that they have read the Terms and accepts them in full.


Article 2 – Application of the Terms and purpose of the Website

The Seller reserves the right to amend the Terms at any time.
The Terms in force on the day of the order shall apply.

The Website offers the online sale of products within the Seller's field of activity.
Access to the Website is free of charge. Any order implies full acceptance of these Terms.

The Customer declares that they have the required legal capacity or that they act with the authorisation of their legal representative.


Article 3 – Customer service

Any request must include the first and last name, the subject of the request and the order number.

Business enquiries are also handled exclusively by email at contact@hyralia.com.


Article 4 – Orders and purchase process

The products offered are those displayed on the Website.
The photos have no contractual value.

The Customer freely assembles their cart and can modify it before confirmation.
The order becomes final upon confirmation of payment and acceptance of the Terms.

The confirmation date corresponds to the actual receipt of payment.


Article 5 – Prices and payment terms

Prices are stated in euros including VAT, plus shipping costs.
Hyralia reserves the right to change its prices at any time.

Accepted payment methods are credit card, Apple Pay, Klarna and PayPal.
The Website never has access to the Customer's banking details at any time.

Invoices and order confirmations are archived on a durable medium.


Article 6 – Deliveries

Shipping costs and delivery times are indicated before the order is confirmed.
Deliveries are available worldwide.

The times given are indicative and may depend on external factors.
In the event of a delay of more than 30 days, the Consumer may request the termination of the contract.


Article 7 – Right of withdrawal

The Consumer has 14 days from receipt to exercise their right of withdrawal.
Return costs remain the responsibility of the Customer.

The refund is made via the original payment method after receipt of the product in perfect condition.

A model withdrawal form is available in these Terms.


Article 8 – Product warranty

The products benefit from the legal warranties of conformity and against hidden defects in accordance with the applicable regulations.

In the event of proven non-conformity, the product will be replaced or refunded.
In this case, the return costs shall be borne by the Seller.


Article 9 – Liability

Hyralia cannot be held liable in cases of force majeure or indirect damage.
The selection and use of the products are the sole responsibility of the Customer.


Article 10 – Force majeure

Any unforeseeable event beyond the parties' control suspends the performance of the contractual obligations.
After more than 90 days, the contract may be terminated by either party.


Article 11 – Intellectual property

All content on the Website is protected by copyright.
Any reproduction or use without written authorisation is strictly prohibited.


Article 12 – Personal data

Data is collected for the management of orders, customer relations and the improvement of the Website.
It is kept for a maximum of 5 years.

In accordance with the GDPR, the Customer has a right of access, rectification and erasure.
These rights may be exercised by email at contact@hyralia.com.


Article 13 – User comments

Comments submitted may be freely used by Hyralia.
The Customer remains solely responsible for the content published.


Article 14 – Severability clause

Should any clause be declared void, the remaining clauses shall remain applicable.
These Terms supersede any prior agreement.


Article 15 – Applicable law and mediation

These Terms are governed by the applicable law.
The Customer may use mediation via the European online dispute resolution platform.

Mediation is free of charge and does not preclude any subsequent legal action.
